By ordering products from Living Gracefully Design or accessing any material, information or services through the website you are deemed to have read and agreed to the following Terms and Conditions. Please carefully read the following Terms and Conditions and make sure that you understand them before placing an order with Living Gracefully Design.
Terms and Conditions
Contract
Your acceptance of a Living Gracefully Design Contract constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Living Gracefully Design. No other agreement whether verbal or written shall be in effect, except where agreed to and authorized in writing by Living Gracefully Design.
Definitions
The terms “we,” “our,” and “Calligrapher” refers to Living Gracefully Design.
The terms “Client(s)”, “you”, refer to site customers, users, clients, and any other financial investors of our services.
The term “Contract” or “Invoice” shall refer to the customized services, plans, and fees Living Gracefully Design has created for the Client.
Proofs
Electronic proofs are sent approximately 7 business days after an order is placed for all relevant stationery items. It is the responsibility of the client to check layout, dates, times, color, font, spelling, and grammar to the client’s satisfaction. The electronic proof can be amended as many times as necessary, and a revised electronic proof will be sent approximately 7 business days after revisions. You will then be required to sign a Digital Design Approval Agreement as confirmation of the proofs. If the design should change dramatically during the proof process, a new cost proposal must be approved.
No proofs will be supplied for items requiring printed guest names, for example, place cards and table plans. You will need to supply us with a list of names, and it is your responsibility to ensure that spellings are correct. Should you require any amendments to the names after supplying us with the list, additional charges will be incurred.
Please note that the color on your screen may differ from the printed color. It is therefore advisable to print off all proofs before signing the Final Design Approval Agreement. Please keep in mind that printers also vary and that your final stationery will be printed on the highest quality professional print press therefore the colors may differ slightly. We reserve the right to substitute materials for similar products should materials become unavailable, however, we will inform the client.
Ordering
Your order will be considered to have been placed after your completed order form and payment has been received by Living Gracefully Design. The invoice may exclude delivery and assemblage fees. You should order all required items at the time of placing the order. Where you do not have precise numbers for additional items, approximate numbers should be used. These can be adjusted at the time of the final guest count in the Final Invoice.
Payment and Cancellation
Submitting the 50% non-refundable retainer online through the emailed invoice or by check is required prior to the digital proof. With your initial invoice, you will receive a timeline for the digital and hard copy proof approvals. Your deposit is nonrefundable. Living Gracefully Design reserves the right to change prices at any time without prior notice. Your invoice remains valid for a period of 6 months from the date on the quote and shall not be affected by any price increases during this period.
Your order will be considered to have been placed after your completed order form and payment has been received by Living Gracefully Design. Full payment for stationery is required prior to the hard copy proof of your order. Rush fees will be applied if changes or additions are made or if client deadlines are not met. Should final payment and/or design approval not take place, the client will forfeit the retainer and the contract will be terminated. If you decide to cancel the job prior to printing, you will forfeit the retainer and the contract will be terminated.
Cancellations will not be accepted after the job has been sent to printing. You cannot cancel any part of your job once the Digital Design Approval Agreement has been signed to include quantities of each item.
Living Gracefully Design cannot be responsible for unforeseen circumstances "acts of God", which may make it impossible for me to complete your job in a reasonable amount of time. My complete obligation to you may be discharged in its entirety by my refund of your deposit, without prejudice, and disclaiming any secondary consequences or costs that you may incur.
Supply of Information
You are responsible for ensuring that all information is correct to include the spelling of names, dates, and layout. Printing of stationery will begin immediately after the Final Design Approval Agreement.
The Digital Addressing List must be submitted with the Digital Design Approval Agreement. Your addresses will be printed exactly as you submit them.
Calligraphy/Fancy Writing
Client has reviewed Calligrapher’s work and has a reasonable expectation that their designs will be produced in a similar manner and style. Calligrapher will use reasonable efforts to ensure Client’s designs are produced in a style and manner consistent with Calligrapher’s current portfolio and Calligrapher will try to incorporate any suggestions Client makes. However, Client understands and agrees that design is a subjective art, Calligrapher will use her personal artistic judgment to create designs for Client, which may not include strict adherence to Client’s suggestions, It is within Calligrapher’s sole discretion as to how to edit the designs she creates, dissatisfaction with Calligrapher’s aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.
Delivery
Deliveries will be sent to your invoice address unless Living Gracefully Design is informed of a different delivery address. The invoice may exclude delivery fees. Please inform us of any dates you are unable to receive deliveries. Living Gracefully Design cannot guarantee delivery on any specific date. If you require stationery to arrive on a particular date, we will attempt to arrange the delivery to your preferences, but it is not guaranteed.
Living Gracefully Design cannot be held responsible for delays in delivery due to circumstances out of our control, such as weather conditions. Living Gracefully Design shall not be liable for any losses, damages, or expenses incurred by the client caused by delays in delivery or damage or loss during transit. Living Gracefully Design carefully packages the items to avoid damage, but if items suffer damage in transit, a claim must be filed against the carrier (USPS, UPS, FedEx, etc.) to recover the value. Full price will be charged for replacement stationery.
Liability for loss and damage of products passes to you upon delivery or on the date of the first attempted delivery. Once stationery is received by you, it is your responsibility to ensure that it remains in good condition. You are responsible for performing a final check of names and details on stationery before items are sent to guests. Stationery should be stored in a dry environment at room temperature.
Refunds
Living Gracefully Design cannot offer refunds. Any defects of the stationery must be reported to Living Gracefully Design within 48 hours of the items being received by the client. After 48 hours, the items will be deemed accepted by the client.
If the defect is a typographical error by Living Gracefully Design as proven by The Digital Addressing List. Living Gracefully Design shall replace the item(s) affected. In these circumstances, you may be required to return the item(s), in original packaging, and you will be reimbursed for the postage cost. Replacement items will be sent out as soon as possible.
Website
Living Gracefully Design shall not be responsible for any errors or omissions on the website. Materials and colors may not be accurately displayed on a computer screen.
Use of this website is at your own risk. We make no explicit representations or warranties as to the safety or your individual use of the website.
Privacy Policy and Copyright
Living Gracefully Design will not share your personal details with any third party and will not send you any marketing material.
Living Gracefully Design reserves the right to use images of your stationery on our website. All stationery designs on our website are the sole property of Living Gracefully Design and shall not be copied or reproduced in whole or in part, whether for business or personal use. Any infringement of copyright of our designs will result in legal action.
All images and text on this website are the property of Living Gracefully Design (unless otherwise credited) and must not be copied or reproduced without prior consent.
It is your responsibility to obtain the correct copyright permission for hymns, readings or pictures to be included in your stationery. You agree to indemnify Living Gracefully Design against any action for breach of copyright of such items.
Safety
Due to choking hazard, please keep the small embellishments incorporated into our stationery out of reach of children.
Refusal of Service
Living Gracefully Design reserves the right to refuse service to any order, person or entity, without the obligation to assign reason. No order is deemed accepted by us until payment has been processed.
Force Majeure
Living Gracefully Design shall not be responsible for any delays or failure to perform its obligations if such delay or failure is caused by events or circumstances beyond its control. This includes, but is not limited to, acts of God, war, fire, strikes, failure of communications or computer systems, shortage or unavailability of raw materials, or extreme weather.
